The Glass Specialist — Terms & Conditions

These Terms & Conditions (the “Terms”) govern all quotes, proposals, sales, fabrication, delivery, mobile on‑site service, and installations provided by The Glass Specialist (“Company,” “we,” “us,” or “our”) to the customer (“Customer,” “you,” or “your”). By approving a quote, paying a deposit or invoice, scheduling service, or using our website or services, you agree to these Terms.

Plain‑English Note: Cut glass is custom and often tempered/laminated—once made, it cannot be resized. Lead times and pricing depend on measurements, materials, and availability. Please read carefully.

2) Quotes, Pricing & Scope

Quotes/Estimates. Quotes are valid for 15 days unless otherwise stated and are based on the drawings, measurements, and assumptions at quoting time. Pricing may change if scope, materials, hardware, dimensions, code requirements, or site conditions change.

Taxes/Fees. Prices exclude sales/use taxes, disposal fees, permits, parking, after‑hours/emergency premiums, and specialty equipment (lifts, glazing robots) unless specified. Customer is responsible for applicable taxes/fees.

Measurements. If we perform final measure, we fabricate to those measurements. If you or a third party supplies measurements, you assume responsibility for accuracy and fit.

Custom Materials. Tempered/laminated/IGU units, custom mirrors, shower glass, and special hardware are custom and typically non‑returnable once ordered.

Site Conditions. Quotes assume standard access, safe work area, and code‑compliant openings. Hidden or pre‑existing conditions may require a Change Order.

3) Deposits, Payment & Lien Rights

Deposit. A non‑refundable deposit (typically 50% unless stated otherwise) is required to order materials and reserve production time.

Progress/Final Payments. Progress payments may be required (e.g., at material arrival, pre‑install). Final payment is due upon substantial completion or prior to delivery/installation if specified.

Late Fees. Past‑due balances may incur 1.5% per month (18% APR) or the legal maximum, plus collection costs and reasonable attorneys’ fees.

Lien Rights. We reserve all rights under applicable mechanic’s lien laws. Non‑payment permits us to suspend work, withhold delivery, and pursue lien/collection remedies.

4) Lead Times, Scheduling & Access

Lead Times. Lead times are estimates and depend on timely approvals, deposits, shop capacity, supplier schedules (tempering/laminating/IGU), and site readiness.

Scheduling. We coordinate windows for mobile service/installation. You must ensure clear access, power, parking, and a safe, weather‑appropriate environment. Missed appointments or unready sites may incur trip/rescheduling fees.

Storage. If you delay installation beyond 10 calendar days after readiness, storage fees may apply and risk of loss may pass to you.

5) Delivery, Risk of Loss & Installation

Delivery & Risk. Title transfers upon payment in full; risk of loss transfers upon delivery to the site or carrier (if shipped). Inspect deliveries on arrival and note visible damage immediately.

Existing Conditions. We are not responsible for pre‑existing or hidden conditions (e.g., out‑of‑square frames, rotted sills, failed substrates, structural movement, electrical/plumbing conflicts, hazardous materials). Additional work to address such conditions is a Change Order.

Removal Risks. Removal of old glass/mirrors may result in unavoidable breakage of brittle materials, paint/texture pull‑off, or adhesive damage. We are not responsible for cosmetic repairs unless expressly included.

Cure Times. Sealants/silicone require cure time (typically 24–72 hours). Do not stress, clean, or use assemblies until cure is complete.

Third‑Party Trades. Unless included, we do not perform carpentry, electrical, plumbing, tile, or painting. Coordination with other trades is your responsibility. Shower doors often require tile to be complete and plumb before measure/installation.

6) Change Orders

Changes after approval (dimensions, glass type, finish, hardware, layout, site readiness) must be in writing and may affect price and schedule. Change Orders are billable at quoted rates or time‑and‑materials and may require additional deposits.

7) Materials, Safety & Variations

Glass Types. Safety glazing (tempered/laminated) is required in many locations by building code. Once glass is tempered, it cannot be cut or altered.

Natural/Manufacturing Variations. Glass and mirrors may have acceptable industry tolerances in flatness, bow, seed/bubble, light distortion, roller wave, and color tone. Mirrors may include safety backing; edges may vary by polish type.

Hardware/Finishes. Plated/painted finishes may patina or vary slightly by batch.

Customer‑Supplied Items. Use of customer‑supplied glass/hardware is at your risk. We are not responsible for defects, delays, or breakage arising from such items.

Safety. You must keep children/pets away from work areas. Broken glass is hazardous; do not attempt cleanup without proper protection.

8) Tolerances, Waterproofing & Punch List

Tolerances. Reasonable glazing tolerances apply to reveals, gaps, and alignment. Shower enclosures are water‑resistant—not water‑proof. Minor seepage/weepage may occur and is not a defect.

Punch List. Provide a written punch list within 7 days of substantial completion. We will schedule reasonable corrections. Issues visible only under specific lighting/angles or within normal tolerances are not defects.

9) Warranty

Workmanship Warranty. We warrant our installation workmanship against defects for 12 months from substantial completion unless stated otherwise in your quote.

Exclusions. Normal wear; misuse/abuse; impact/thermal shock/settlement; water intrusion from building envelope; use of harsh cleaners/abrasives; failure to maintain; modifications by others; and customer‑supplied materials.

Manufacturer Warranties. IGU seal/fogging, hardware, and specialty coatings are covered by the manufacturer’s warranty, if any. We will assist in good faith with claims but are not responsible for manufacturer decisions.

Remedy. Our obligation is, at our option, repair or replacement of the specific defective part. Access beyond standard removal/reinstall may be chargeable. Warranty is non‑transferable and limited to the original purchaser.

Care Tips: Avoid slamming doors/panels. Use non‑abrasive cleaners. Do not hang objects on frameless shower panels/doors.

10) Website, Digital Tools & Communications

Website Use. By using our websites/forms/chat widgets, you agree not to misuse the services or attempt to disrupt them. Content is provided “as‑is.” Features may change without notice.

Accounts/Portals. If we provide a customer portal, keep credentials confidential and secure. You’re responsible for activity under your account.

SMS/Calls. By providing your number and opting in, you consent to receive service and (if opted‑in) marketing texts/calls. Message & data rates may apply. Reply STOP to opt out. Calls may be recorded with required notices.

Privacy. Our practices are described in our Privacy Policy.

11) Customer Responsibilities

Provide timely approvals, accurate measurements/specs (or allow us to final‑measure), and ensure site readiness.

Provide safe, clear access; power; parking; and weather‑appropriate conditions.

Protect surrounding finishes/furnishings or request protection at additional cost.

Notify us of any special code/HOA requirements, tempered/laminated needs, or safety constraints.

12) Permits, Codes & Hazardous Materials

Permits/Inspections. Unless expressly included, you are responsible for permits and inspections.

Code Compliance. We glaze to accepted standards; final compliance with local codes/HOA rules depends on the site and other trades.

Lead/Asbestos/Mold. We do not remediate hazardous materials. If suspected or encountered, work will pause and a Change Order may be issued for additional handling or third‑party remediation.

13) Emergency Services (If Offered)

Emergency board‑ups/temporary glazing aim to secure openings, not to provide a final aesthetic solution. Temporary materials may have visible fasteners/films/tapes. Final replacements are quoted separately.

14) Delays & Force Majeure

We are not liable for delays or nonperformance due to causes beyond reasonable control, including supplier delays, glass breakage in transit, special‑order backlogs, labor shortages, illness, extreme weather, fire, flood, acts of God, terrorism, strikes, transportation issues, utility failures, or government actions.

15) Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim related to the Services or products shall not exceed the amount actually paid by you for the specific item/work giving rise to the claim. We are not liable for incidental, consequential, special, exemplary, or punitive damages (including lost profits, loss of use, or diminution in value), even if advised of the possibility.

16) Indemnity

You agree to defend, indemnify, and hold harmless The Glass Specialist and its officers, employees, and subcontractors from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of (a) your breach of these Terms; (b) your negligence or willful misconduct; (c) hazardous materials or site conditions not created by us; or (d) instructions, materials, measurements, or specifications you provide.

17) Termination & Suspension

If you fail to make payments when due or otherwise breach these Terms, we may suspend work/delivery or terminate after notice. You remain responsible for work performed, custom materials ordered, restocking fees (if any), storage, and collection costs.

18) Dispute Resolution & Governing Law

Good‑Faith Resolution. We will first attempt to resolve disputes in good faith through management‑level discussion within 15 days of written notice.

Mediation/Arbitration. If unresolved, the parties agree to non‑binding mediation in Placer County, California, and, if still unresolved, binding arbitration under JAMS or AAA rules in Placer County, California. Each party bears its own costs and shares mediator/arbitrator fees equally unless the arbitrator awards otherwise.

Governing Law/Venue. These Terms are governed by California law, without regard to conflict of law rules. Venue is proper in Placer County, California.

Right to Collect. Nothing here limits our right to pursue lien rights or small claims for unpaid amounts.

19) Intellectual Property & Content

IP Ownership. Our designs, photos, drawings, processes, copy, logos, and trademarks remain our property. You receive a limited license to use deliverables solely for the permitted project. Reuse without permission is prohibited.

User Content. If you submit reviews/photos/testimonials, you grant us a worldwide, royalty‑free, perpetual license to use and display such content in connection with our business (subject to our Privacy Policy and any permissions regarding identification).

Prohibited Use. Do not copy site code, bypass security, scrape content, or infringe IP.

20) Miscellaneous

Entire Agreement. These Terms, together with any signed proposal/quote/invoice and approved drawings/specs, are the entire agreement and supersede prior communications.

Order of Precedence. If there is a conflict, a mutually signed proposal/contract controls over these Terms; otherwise these Terms control.

Severability. If any provision is unenforceable, the remainder stays in effect.

No Waiver. Failure to enforce a provision is not a waiver.

Assignment. You may not assign without our written consent. We may assign to an affiliate or in connection with a business transfer.
